These Terms of Use govern your use of emberactiveperformance.com (the “Site”), operated by Peak Performance Chiropractic & Sports Recovery LLC, doing business as Ember Active Performance (“Ember,” “we,” “us”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. The Site is not medical advice
Everything on the Site — including descriptions of services, conditions, and treatments — is general information only.
It is not medical advice, diagnosis, or treatment, and it isn’t a substitute for an in-person evaluation. Always talk with a qualified healthcare provider about your specific situation, and never ignore professional advice or delay care because of something you read here.
2. No doctor–patient relationship
Visiting the Site, submitting a form, emailing, or calling us does not create a doctor–patient relationship. That relationship begins only after you are evaluated and accepted as a patient at our office.
3. Emergencies
Do not use the Site for medical emergencies. If you think you have a medical emergency, call 911 or go to the nearest emergency room.
4. Results vary
Testimonials and examples on the Site reflect individual experiences. Every person is different, and we don’t guarantee any particular outcome from care.
5. Appointments and payment
Online booking is provided through Jane App and is subject to Jane’s terms. Prices shown on the Site are current as of posting and may change. We are a cash-pay practice and do not bill insurance; details about payment, superbills, and our cancellation policy are provided when you book and at your first visit.
6. Acceptable use
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting false or harmful information, or using it for any unlawful purpose.
7. Intellectual property
The Site’s content — including text, images, logos, and the Ember Active Performance name and marks — belongs to Ember or its licensors. You may view and print pages for personal use, but you may not copy, modify, or distribute the content without our written permission.
8. Third-party links
The Site may link to third-party websites and services, such as Jane App, Google, and social media. We don’t control them and aren’t responsible for their content or practices.
9. Disclaimer of warranties
The Site is provided “as is” and “as available.” We try to keep information accurate and up to date, but we make no warranties that the Site will be error-free, uninterrupted, or complete.
10. Limitation of liability
To the fullest extent permitted by law, Ember will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site. Nothing in these Terms limits liability that cannot be limited under law.

Our Privacy Policy explains how we handle information collected through the Site. Patient health information is covered by our Notice of Privacy Practices.
12. Governing law
These Terms are governed by the laws of the State of Colorado. Any dispute will be handled in the state or federal courts located in El Paso County, Colorado.
13. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted means you accept the updated Terms.
